Home / Solutions · Building an overseas brand
From making for other labels to selling your own brand abroad
Your factory already makes a good product, but most of the margin and the customer relationship sit with the buyer's brand. We help OEM/ODM factories and young Chinese brands protect the name first, pick one product and one market, then build the site, reviews, content and search presence that make overseas shoppers remember and look up your name.
- Best for
- OEM/ODM factories with proven products and capacity, and young Chinese consumer brands starting overseas
- Usual channels
- Brand website, Amazon, Google Search, creator content on Meta and TikTok, market research, localization
- What usually changes first
- Trademark filings are under way; the first-stage aim is for your own pages to make up more of the results for your brand name, and for the first genuine reviews to start coming in
Does this sound familiar?
These are common sticking points when a factory turns into a brand.
Orders keep growing, margins keep shrinking
You make the product, but the buyer sets the price. Every year brings another round of quotes and price pressure, and the only lever you control is cost. WIPO research found that a large share of the value of manufactured goods comes from intangibles such as brand, design and technology rather than from production itself 1, and right now that share is not yours.
Two or three big buyers decide your year
When one large customer switches suppliers, a production line goes quiet. You have no direct line to the people who use your product, and no idea why they buy it or why they send it back. Building your own brand is, at its core, about owning that customer relationship.
Shoppers look up your name and hesitate
Faced with an unfamiliar name, a common habit is to search it with words like reviews or legit before buying. If what comes up is a few reseller listings, one forum thread, or nothing at all, shoppers easily drift back to the brand they already know.
Selling before the name is protected
Trademark rights are territorial, so a registration in China does not protect you in the US or the EU 4. Many factories list products first and file later, then find the name taken, or find they cannot enroll in Amazon Brand Registry 8, and everything built on that name has to start over.
Everything, everywhere, all at once
The catalog has dozens of SKUs and the plan covers the US, Europe and the Middle East at the same time. Budget and attention spread thin, no single product gets a real foothold in any one market, and shoppers cannot tell what you stand for.
Worried your brand will upset existing OEM customers
Your product looks a lot like your customers' products, and may come off the same line. Selling it directly can raise questions about contracts, tooling ownership and pricing. This needs to be thought through before launch, not explained after a customer finds out.
Why the jump from factory to brand is hard
In 2017 the World Intellectual Property Organization put a number on something most factory owners already sense. Across 2000 to 2014, about 30.4 percent of the total value of manufactured goods sold worldwide came from intangible capital such as branding, design and technology. In 2014 that intangible share was worth about USD 5.9 trillion, roughly twice the contribution of tangible capital like buildings and machinery 1. Contract manufacturing pays you for production. The value that comes from brand and customer relationships stays with the label on the box.
Trust is the first gate for a Chinese brand
Overseas shoppers owe a new name nothing. They look it up on Google, read reviews, check whether anyone independent has mentioned it, and look for real people and real company details on the website. Google's own guidance on content quality is direct about this: among experience, expertise, authoritativeness and trustworthiness, trust is the most important, and making it clear who created a page, citing sources and linking to an About page are ways to show it 2. A factory that has just started its own label has usually never gathered or published that evidence.
Search engines also need to recognize you as a real brand. Organization structured data helps Google understand your company's administrative details, choose which logo appears in results and in your knowledge panel, and connect your site to your social and marketplace profiles through sameAs links, which separates you from similarly named companies 3.
Protect the name before you promote it
Trademark rights are territorial. A US registration creates rights only in the United States and its territories, and protection elsewhere means registering in that country 4. In the US, foreign-domiciled applicants must be represented by an attorney licensed to practice in the United States 5. In Europe, one registration with the EUIPO covers every EU member state, and in most countries protection lasts ten years from the application date and can be renewed for ten years at a time 6. To cover more countries, WIPO's Madrid System lets you file one international application and pay one set of fees, provided you already have a national or regional application or registration in a member office; as of 2026 its site lists 133 countries covered 7. The trademark also unlocks channels. Amazon Brand Registry requires an active registered or pending trademark 8, and tools such as A+ Content, Brand Stores, Amazon Vine and Brand Analytics sit inside that program 9.
The rules have changed, and shortcuts cost more
Fake reviews are now explicitly banned in the US under the FTC's 2024 final rule 10, and Amazon actively screens out suspected fakes 11. What new brands overlook more often is the creator side. The same rule also treats buying or selling fake followers and views as a violation 10, and the FTC states that a company is ultimately responsible for what others do on its behalf 12. If a creator leaves a paid relationship unlabeled, that is the brand's problem as well as the creator's. A new brand needs exactly the slower kind of trust evidence that holds up: reviews from real buyers, creator content that is clearly disclosed, and company details shoppers can check for themselves.
How we do it
Six steps, from asking whether you can build a brand to proving that it is growing.
- 01
1. Brand starting-point review
We look at your products, capacity and customer mix, then search your brand name across the target market's search results, marketplaces and social platforms. The parts of your OEM contracts that could affect an own brand (tooling, design rights, sales territory, non-compete) go onto a list for your lawyer to review. The goal is one answer: are you ready to build a brand, and where is the safest place to start.
OutputA starting-point report covering strengths, risks and a recommended way to begin, plus a list of OEM contract clauses for your lawyer to review.
- 02
2. One hero product, one market
Using market research plus search and marketplace data, we compare a few candidate products in one or two target markets on demand, competition and what reviewers complain about. We look for the product where your manufacturing gives you an edge and you can explain the difference. One product done properly in one market is easier to remember than ten spread thin.
OutputA recommended hero product and launch market, with the recurring pain points in competitor reviews and your point of difference.
- 03
3. Name and trademark first
Before any promotion, get the basic picture of the name in the target market: similar brands already selling, and whether the domain, the main social handles and marketplace store names are taken. The formal clearance search and the filing itself belong with the attorney you appoint, whether in the US, the EU or through the Madrid System 567. Once a filing is in, Amazon Brand Registry can be planned 8.
OutputA name checklist to work through before you file, and a list of markets to protect.
- 04
4. A brand website as home base
The site is not a catalog. It is where people find out who the brand is and whether it can be trusted: the real team and factory, the brand story, warranty, returns, shipping and contact details, written in the language and habits of the target market. We add Organization structured data and consistent brand facts 3 and set up tracking.
OutputA localized brand site with trust pages, a hero product page and complete conversion tracking.
- 05
5. First genuine reviews and creator content
Reviews come only through routes the platforms allow, such as Amazon Vine where you qualify 9 and review requests to real buyers on your own site, with no condition on a positive rating 10. Before working with creators on Meta and TikTok, set the disclosure rules: use the platform disclosure tools and state the relationship in the content, in line with FTC guidance 1314. With the creator's permission, that content can then be reused in ads and on the site.
OutputA review plan, a disclosure checklist for creator partnerships, and advice on reusing the first batch of content.
- 06
6. Measure growth through branded search
Each month we check whether more people search for your name and click through, how reviews are building, and which channel brought new customers. Google Search Console can now separate branded from non-branded queries 17, which is a direct signal of whether people are starting to know you.
OutputA monthly report on branded search, review progress, orders by channel and next month's adjustments.
The usual way versus our way
Starting a brand is easy. Not having to start it twice is the hard part.
| Topic | The usual approach | How Clickto does it |
|---|---|---|
| Trademark | List first, file once something goes wrong. | Check the name before promotion, have your attorney file market by market 4, then plan platform brand registration. |
| Product and market | Upload the whole OEM catalog and open several countries at once. | One hero product and one launch market, chosen with data, expanded once it holds. |
| Website | A factory profile plus spec sheets, in English that reads like a translation. | A consumer brand site with real people, warranty and returns, written to Google's trust principles 2. |
| Reviews | Buy reviews or swap free products for five stars. | Only platform-approved methods, no sentiment conditions, in line with the FTC rule 10. |
| Creators | Pay for videos and leave the relationship unlabeled. | Use platform disclosure tools and state the relationship clearly in the content 131415. |
| Measurement | Watch sales and ad spend only. | Track branded search, reviews and new customers by channel to see whether the brand is really growing 1617. |

Questions
We are a contract manufacturer. Do we really need our own brand?
Not every factory does. If your OEM orders are steady and the margin is acceptable, an own brand is a long-term option rather than an urgent one. If you depend on a few large buyers or face price cuts every year, a brand gives you back some pricing power and a direct customer relationship. WIPO research shows that a meaningful share of the value of manufactured goods comes from brand, design and technology 1. Our assessment will tell you plainly, including when the honest answer is not yet.
Will our own brand clash with our existing OEM customers?
It can, so it needs to be handled before launch. Step one is having your lawyer read the OEM contract clauses on tooling ownership, design rights, sales territory and non-compete; the assessment can list which clauses need that review. Step two is comparing how close your branded product sits to your customers' products in look, function and price. Common answers include choosing a category or market your customers do not cover, a clearly different design, or running the brand through a separate entity. Your lawyer has the final word on how the contract reads.
Where should we register the trademark, and which market first?
Register where you plan to sell, because trademark rights are territorial 4. In the US you file with the USPTO, and foreign-domiciled applicants need a US-licensed attorney 5. In Europe, one EUIPO filing covers every EU member state 6. For several countries, the Madrid System lets one application designate many of them 7. Protect the launch market first and add others as you expand. Clearance searches and filings belong with your IP attorney.
Can we sell on Amazon before we have a trademark?
You can list, but it is hard to build a brand that way. Amazon Brand Registry requires a registered or pending trademark 8, and A+ Content, Brand Stores, Sponsored Brands, Amazon Vine and Brand Analytics all sit inside it 9. Without those tools your listings are hard to tell apart from copycats and resellers. We recommend filing the trademark first and then planning the listing timeline.
How does a new brand get its first reviews?
Along two tracks, slower but safe. On the brand site, send the same review request to every real buyer after delivery, whether they are likely to be happy or not, and never reward a positive rating 10; reviews from staff, friends or family should state the relationship, or be left out. On Amazon, once the brand is in Brand Registry, eligible products can use Vine 9. Critical reviews are useful too: answer them properly and take recurring complaints back into the product. When bought reviews are caught by the platform 11, the whole brand pays for it.
What should we watch for when working with overseas creators?
Disclosure, above all. The FTC expects creators to disclose any financial, employment, personal or family relationship with a brand, free products included, and to place that disclosure with the endorsement itself 13. TikTok requires creators to turn on its commercial content disclosure setting when promoting a brand 14, and Meta has its own Branded Content Policies 15. The FTC also says the company is ultimately responsible for what others do on its behalf 12, so it is worth giving every creator written disclosure instructions and checking each post against them before it goes live.
How do we know the brand is actually growing?
Watch how many people search for your name on their own. Search Console's Performance report shows the queries that bring traffic, plus clicks, impressions, click-through rate and average position 16, and since 2025 a branded queries filter separates branded from non-branded searches 17. Google classifies these with an AI-assisted system that sometimes gets it wrong, so it pays to cross-check with query filters. Add review growth and new customers by channel, and you can see whether the brand is building.
We only have a factory website. Can we turn it into the brand site?
Usually not. A factory site speaks to buyers about capacity, certifications and minimum order quantities. A brand site speaks to shoppers about use, warranty and support. The readers and the searches are different, and mixing them serves neither well. The usual recommendation is to keep the factory site for B2B enquiries and build a separate brand site, with structured data and consistent facts that make the brand entity clear 3.
